The Client acknowledges that hunting is an inherently dangerous activity that carries an elevated risk of damage of property damage and personal injury and death. As such, the Client agrees to: (a) waive any and all claims of any nature, whatsoever, which the Client has now or in the future against MMO resulting from or relating to the Client’s attendance at the MMO hunting accommodations and/or his or her participation in the Hunt, and to release MMO and its directors, officers, shareholders, employees, contractors, and agents (collectively, the “Released Parties”) from all liability, whatsoever, for any losses, expenses, damages, or injury (including disability and/or death) that the Client may suffer due to his or her attendance at the MMO hunting accommodations and/or his or her participation in the Hunt due to any cause whatsoever, save for the gross negligence or willful misconduct of MMO; and (b) indemnify, hold harmless, and forever discharge the Released Parties from and against all manner of actions, causes of action, suits, debts, sums of money, damages, costs, claims, and demands of every nature, whatsoever, including third party claims, which may exist at law, common law, equity, under any statute or legislation, or in any Canadian or foreign court, administrative body, mediation, or arbitration proceeding, whether asserted or unasserted, directly or indirectly relating to or arising from the Client’s attendance at the MMO hunting accommodations and the Client’s participation in the Hunt, save for any actions, losses, or damages that arise due to the gross negligence or willful misconduct of MMO. If despite this waiver any person claiming on, by, or through the Client makes any manner of claim or commences any form of legal or quasi-legal proceedings against a Released Party, the Client will indemnify, save, and hold MMO harmless from and against all litigation expenses, solicitor/client fees on a full indemnity basis, losses, liability, damages, or costs of every nature which MMO may incur because of such claim or the commencement of such legal or quasi-legal proceedings.



The Client expressly acknowledges that in no event will the Hunt commence until the Balance Owing has been paid in full. The Client will be solely responsible for the following costs: trophy packaging and shipping, meat processing, food and beverage other than what is provided by MMO, gratuities, and any other cost not expressly assumed by MMO herein. All amounts to be paid by certified cheque or wire transfer (please allow 3 weeks for postage delivery). In no event will the Client be entitled to a refund of the Non-Refundable Deposit. All amounts are in United States Dollars.



The Client will be responsible for the following matters:
(i)
providing all equipment, including, but not limited to, bow/arrows, rifle/ammunition, clothing, backpack, gloves, optics (binos/spotting scope) + window mounts/tripods, range finder, shooting sticks, boots, gators, walking poles; etc.. and
(ii)
providing assistance, wherever required, to the guide in transporting harvested game (meat, cape, and antlers) including packing or dragging the animal back to the pickup truck. A backpack suitable for packing up to 75lbs is required.



MMO reserves the right to immediately terminate the Hunt at its sole discretion, with no reimbursement or liability to the Client, upon the occurrence of any of the following:
(i)
the Client wounding an animal, it being expressly acknowledged that a wounded animal will be deemed to be a harvested animal for the purposes of this Agreement;
(ii)
the Client engaging in or suggesting that the Client or MMO engage in illegal or unethical activity;
(iii)
the Client willfully damaging the personal property of MMO or of any other person; or
(iv)
the Client engaging in disrespectful or harassing behavior towards any person, including the outfitter, any guide, any landowner, any lease holder, and other hunters.
(b)
If the Hunt is terminated for any reason set out in Paragraph 6(ii)-(iv), inclusive, then the Client and the Client’s equipment will be transported to a hotel in Medicine Hat, Alberta, and thereafter the Client will be solely responsible for making all travel arrangements to return home and MMO will be relieved of any and all liability relating to the same.



The Client acknowledges that MMO will retain complete ownership of any and all photos and/or videos taken by MMO or its representatives during the Hunt and that it will be entitled to utilize any such photos or videos, including photos or videos that contain the Client or the Client’s likeness, for commercial purposes including, but not limited to, in person, online, and television advertising and promotion, at MMO’s sole discretion. MMO agrees to provide the Client with any photos or videos taken during the Hunt by MMO or its representatives upon the Client’s request and MMO grants the Client a perpetual, non-exclusive license to use any such photos or videos for non-commercial and non-monetary purposes. Any photos or videos provided by MMO will contain MMO’s watermark and the Client agrees not to alter any such photos or videos in such a manner that would result in the removal of MMO’s watermark.
